CALIFORNIA: Toxic Ash Found In California? Ask Covanta's Vera Carley

What will Covanta do with the toxic ash from the proposed Poolbeg Incinerator?  Export it to Cork?  Spread it over orchards?  Feed it to dioxin-free-pigs in Ireland? Or dioxin-free-buffalo in Italy? Of course not.  But nobody knows either - the promoters are staying stum.


Dumping dodgy ash in California is not a good idea. People in California's land  of milk and honey have issues with Covanta's lovely and environmentally awesome ash [Jan 28, 2010]. They've even switched off a power plant in Oroville, 120 miles from San Francisco.  Questions from locals are passed off 'back east' to a phone number 3,000 miles away, and it seems there is nobody answering during the daytime, never mind at three in the morning.  Skype Covanta yourself: 00-1-973- 882-2439.


If you really really think you'll get an answer about whether the California ash is good ash or very very bad ash give Vera a call.  Start off on a light note with Vera by joking about Billy Leotardo's ashes up on the mantlepiece in New Jersey.  Ask is Covanta better than PG&E.  Ask about Covanta's web site highlighting environmentally friendly business practices.  Then ask about San Francisco's Farmers Market and the ash in the California orchards.

Pacific Oroville Power hits off switch

OROVILLE — The burner at Pacific Oroville Power, Inc. on South Fifth Ave. hasn't been blowing smoke for more than a week.

Exactly what is going on is unclear, except the ash disposed by the company at a Sacramento landfill and spread on local orchards apparently didn't pass tests by the California Regional Water Quality Board Central Valley Division in Sacramento.

And the plant could be the subject of an investigation by the Butte County District Attorney's Office.

Last week, plant manager Francisco Barraga said the building at 3050 S. Fifth Ave. was closed two weeks for scheduled maintenance.

When asked if the closure had anything to do with ash from the plant not passing tests by the water quality board in Sacramento, Barraga said any further questions would have to be answered by public relations representative Vera Carley at Covanta Energy's office in Fairfield, N.J.

Several calls to Carley and another public relations person weren't returned.

Tuesday, Greg Cash of California Regional Water Quality Control Board Central Valley Region in Redding said his office hadn't tested the ash yet.

The Sacramento office had tested ash dumped at the L&D Landfill Co. in Sacramento, Cash said.

Cash said the Redding office would be testing ash at the plant on Wednesday for a Butte County District Attorney investigation. District Attorney Mike Ramsey declined to comment.

Last week, the Oroville plant rented receptacles from Recology in Oroville and had been gathering up the ash in the plant yard.

Recology manager Joe Matz said they will not be taking the ash and they haven't ever taken ash from Pacific Power.

On Tuesday, Moses Detoro of L&D Landfill confirmed it had stopped taking the plant's ash because of testing by the regional water quality board.

"I was told not to take any more ash from POPI until further notice," Detoro said.

He said further information would have to come from the main office.

On Tuesday and Wednesday, neither the Sacramento water control board office, nor Jeff Mills from the landfill main office returned the Mercury-Register's phone calls requesting more information.

Wednesday at 2 p.m., people from water control board and from the plant walked out of the locked gate at the front parking lot.

One woman confirmed they were from the water control board. However, the plant manager said he didn't know when the plant would open again, and any information would have to come from the Covanta public relations office.

Covanta has owned the cogeneration plant in Oroville since 1997 and its Web site highlights environmentally friendly business practices.

The Oroville plant has burned "biofuel" for 25 years to make electricity, which is sold to PG&E.

Poolbeg Crime Against The People Of Dublin. (Cargin)


Proceeding with the Poolbeg Incinerator development in the knowledge of these reports would amount to a crime against the people of Dublin.

Scrapping Poolbeg incinerator plan



Madam,  

Dublin City Council members concerned about the costs of scrapping the Poolbeg incinerator should balance such figures against the vastly greater and unsustainable long term costs of proceeding with this destructive project (Front page, December 30th).  Among these costs would be those in relation to climate change emissions, health, resource depletion and energy wastage, not to mention gate fees under the financially disastrous “put or pay” arrangements.

With regard to carbon emissions alone, it would be wise to scrap the project. European environmental consultant Eunomia has calculated that the carbon cost of incineration with combined heat and power would be £10.21 per tonne as compared with £6.01 per tonne for mechanical and biological treatment (MBT) with anaerobic digestion generating heat and electricity. The equivalent euro savings on a 600,000 tonne facility would more than justify the costs involved in cancellation.

With regard to health costs, cutting edge reports from Prof Vyvyan Howard and other eminent physicians and toxicologists are now in the possession of An Bord Pleanála and the Department of the Environment.  These all strongly advise against the building of new incinerators, warning of the toxicity of ultra-fine particulate emissions and their ability to be blown large distances, contaminating farm and pasture lands and passing through the pulmonary cell walls. Proceeding with the development in the knowledge of these reports would amount to a crime against the people of Dublin.

In terms of resource protection, scrapping the incinerator is a no-brainer.  We know that if we wish to survive on this planet we need to design our products and processes with energy efficiency and the environment as a sine qua non.

By having the courage to do the necessary U-turn on Poolbeg, this Government can take the vital first step in the opening up of new job opportunities in expanded reclamation industries, while putting in place incentives for more intelligent product design for the preservation of natural resources for future generations.

Poolbeg Incinerator -Finances, Alternatives

Firstly the issues about the cost of this project must be raised again and again. You are correct that Dublin CC have been landed with a huge bill to manage the project so far, however from my reading of the information to date it is now well over €30 million and not the (€19 million) figure quoted here. The omissions include the various additional costs within Dublin CC and Bord An Pleanala as well as Government and the various other Consultants employed by the Ministry – and it wont stop there!

The second part of the costs issue relates to the fact that the advised Tender Cost by Dong is farcical and wholly inaccurate and in the light of forthcoming and approved Environmental Legislation to be enacted before 2019 will be exceeded by a huge amount. These include the adoption of stringent particulate emission control as well as preventing the emission of the Persistent Organic Pollutants (POPS) which is covered under Irish and European Union Legislation following UN edicts included in the Stockholm Convention. In addition though, even more interesting, is the fact that by 2019 all incineration plants will be required to install equipment to capture all the carbon dioxide they emit.


These issues are already defined and known about and without a doubt the additional costs of around €180 million will have to be borne by the Irish Tax Payers as they would be considered ”additional” to the base and the premise by which the existing offer in response to the call for tenders was invited. It is worthy to note that under EU Procurement Directives this change to a proposal is declared to be significant enough and of such a high value as to declare the existing offer for incineration to be invalid. Accordingly the Minister has a right on behalf of the Government to declare [the existing & secret contract] should be thrown out.

My comment in response is that if you follow the links in the ”Google web” search engine there is a ready answer here based upon full recycling of the raw waste and the subsequent treatment of the residual waste which is called here ”biodegradable municipal waste (BMW)” to make the biofuel ethanol for transport uses. In these items a statement about the best way forward as an alternative was raised in discussions about 2 or 3 years ago with the Government in Dublin which stated that:
(i) by fully recycling materials from the waste and recovering them and the inert materials – removing them from the waste,
(ii) there were no environmental down sides compared to incineration (no toxic emissions) because the process was totally enclosed and wet,
(iii) that all the residues were all able to be reused.


I understand that in discussions about this proposition a budget was given at less than €100 million for the equivalent project for Dublin’s Ringsend project and that it did not need a gate fee (treatment fee) any higher than €30-00 per tonne.


I understand and hear that a number of projects using the same system have been given approval to start in Holland, Yorkshire (UK), Kentucky, Hawaii, and Viet Nam with others to be announced by November 2009.


So as these projects are now going ahead – even in England – and they are all firmly costed in line with this proposal which was stated for Dublin and to the Ministers then there cannot be any doubt that the Government here must change its direction here, And the Minister John Gormley TD and his compatriot Eamon Ryan TD must act now and quickly to stop this nonsense in Ringsend.

Green Party Worse Than Fianna Fail



Allegedly the Green Party was out telling 'lies' about the Poolbeg Incinerator before the last election, according to comments from senior people employed to promote the incinerator.

More Green Party Spin consistent with The Big Lie includes:
  • The Green Party is not currently educating the Dublin public about potential Poolbeg Incinerator pollution.
  • The Green Party is not currently demanding baseline Dublin health studies for the general Poolbeg area, and preferably for all of Dublin.

The Pontious Pilate and 'lying'(a) Green Party is now worse than Fianna Fail. At least everyone knew what to expect from Fianna Fail, run by The Galway Tent Cartel(b). The Greens have set back the credibility of environmental issues in Ireland by decades.

Even More Covanta Pollution Violations - Poolbeg Waste To Toxins Incinerator Operator, Covanta

DCC's friend Covanta looks like it could be an awesome operator of the proposed Poolbeg Incinerator, a waste-to-toxins factory which will most likely increase premature deaths across Dublin.

Billionaire mogul Zell sold his massive residential and commercial real estate empire in 2007 for $39 billion. Last year, Mr Zell's shareholding in Covanta was worth $666 million. Covanta's CEO was paid $3 million. The small fines imposed on Covanta are a serious joke. Even Seanie would agree they are ridiculous if he wasn't working with the banks on the NAMA scam.

Covanta has been fined for air pollution violations at five plants in three US states. A company spokeswoman, Vera Carley, did not dispute the findings.

The documents, verified by the Poughkeepsie Journal of New York, show that the plants, operated by Covanta Energy Corp. of Fairfield, N.J., emitted excessive levels of the pollutants nickel, soot [dangerous PM10's ?], carbon monoxide and sulfur dioxide and failed at times to adhere to minimum burning temperatures that help control smokestack pollutants.

In one case, a Chester, Pa., plant was fined $45,600 last October for emitting double the permissible level of the heavy metal nickel; five months later, it was again cited, for "multiple violations."

In another, a Pittsfield, Mass., plant was fined $7,650 last September for emitting more than four times the permissible level of highly toxic dioxin; the plant failed for three months to report operating anomalies as required by state regulators, the documents show.


In addition to the environmental citations, Covanta also faces charges by the USA's National Labor Relations Board that it has engaged in unlawful labor practices. The union also provided documents showing Covanta was fined around $20,000 this year by the U.S. Department of Labor's Occupational Safety and Health Administration for 11 "serious" worker safety violations at the West Wareham plant. They included exposing workers to electric shock hazards and potential heat burns; failing to maintain emergency lighting and other equipment, and improperly storing combustible acetylene cylinders.

"Covanta is hostile to workers' rights in the extreme," said Mark Brooks, a union spokesman, adding the company "has a very flawed track record" on environmental and worker safety issues.

Covanta Incinerator Leaves Land Polluted with Dioxins, Arsenic, Polycyclic Aromatic Hydrocarbons

When Covanta leaves toxins and destroyed wildlife at an Incinerator site in the USA why would anyone rely on the New Jersey outfit in Ireland? Apart from the patriotic Fianna Fail and Green cronies of the Galway Tent Cartel.

The Massachusetts site [1] was simply buried in three feet of soil because that was the cheapest option!

It seems Covanta dodged any responsibility for cleaning up after its waste-to-toxins incineration caper. The local state had to pay up for the cheaper-is-better pollution containment. Perhaps Covanta gave a few shekels to the local advertising-desperate-press for some of the usual spin. Perhaps not. No doubt Covanta's lawyers ensured they stuck to the letter of the law.

Here's a cynical spin sample from the paper:

They call the result Covanta Park, an awesome version of Dublin's polluted Sean Moore Park (Sandymount Dump Park). Who needs EPA professionals when you have gutsy all-American teenagers with hammers!

Incinerator firm hopes to raise $400 million bond


The US firm leading the consortium to build an incinerator at Poolbeg in Dublin is attempting to raise $400 million from bond investors to part-finance the project.

Covanta, a US-quoted energy firm, is heading Dublin Waste to Energy Ltd, which has been awarded the contract to build and operate the incinerator. The consortium recently assured Dublin City Council that all funding was in place for the project.

However, Covanta has struggled to secure finance for phase one of the project, and is now seeking to raise $400 million through ‘‘cash-convertible senior notes’’. It is proposing to pay investors a return of 6.5 per cent a year on their capital. [Should read 3.25% p.a. ??]

In documents filed last week with the Securities and Exchange Commission in the US, Covanta said the net proceeds of the bond issue would be used for working capital, including ‘‘funding a portion of the construction cost for a 1,700 metric energy-from waste facility in Dublin’’.

It is understood that Covanta had tried to raise bank debt, but no institution was willing to act as the primary banker to the Poolbeg project, due to the lack of liquidity on the international credit markets.

However, a number of lenders have informed the consortium that they may consider part-financing latter aspects of the project. The planned incinerator is a central element of the country’s waste management strategy. If completed as planned, it will burn 600,000 tonnes of waste a year, creating electricity for 50, 000 homes and hot water heating for a further 60,000 households. However, there has been opposition both to the Poolbeg project, and to incineration in general in Ireland, with a number of projects beset by delays.

Last week, John Gormley, the Green Party Minister for the Environment, is sued a circular which stated that he would introduce a levy to be borne by companies incinerating waste and anybody selling waste for incineration.

Gormley has also instructed the director general of the Environmental Protection Agency (EPA),Dr Mary Kelly, and all council managers nationwide, that they must in future ‘‘refrain from exercising their powers in such a way as to direct waste to landfill or incineration’’.

Gormley told the EPA and the council heads that he was initiating a Strategic Environmental Assessment (SEA), instructing them that government policy had taken decisive steps to encourage recycling and discourage incineration.

Green-FF Desperate Untruths on Incinerator?

Green-FF looks right, looks desperate.

There are Local and European elections coming up in June 2009. Did the Green Party publish a truth behind a lie behind the untruth behind a mistake behind the spin?

On Sunday, May 17, 2009, the Green-FF's leafleted houses with the spin that the Poolbeg incinerator would "collapse" because Covanta could not get finance.

However on Monday, MAY 18, 2009, the Wall Street Journal (WSJ) reported Covanta was selling at least $300 million in 5-year cash-convertible notes to private entities for incinerator construction in Dublin.

The WSJ states:

"Covanta said proceeds from the offering, which will be private, could be used for items including plant construction in Dublin along with potential investments or acquisitions."


Green-FF omitted this Covanta statement from The Sunday Tribune of May 17, 2009:

A statement issued to The Sunday Business Post on behalf of Covanta Europe president Scott Whitney said the company was

‘‘in the final stages of pre-construction activity, the financing to construct the facility is available and we expect to commence construction when the remaining statutory approvals have been received’’.


And
Green-FF also omitted this Dublin City Council statement from The Sunday Tribune:

Seamus Lyons, Dublin Assistant City Manager, who heads the council’s environmental and engineering department, said that Dublin City Council was ‘‘satisfied that Covanta has finance in place’’.

EU Wonders Were Poolbeg Incinerator Hearings a Sham?

The Green-FF government does not care the Poolbeg Incinerator hearings were a political sham - they themselves and their €200,000 pensions come first. To divert the public during the elections perhaps it'd be a great idea to issue a report on 60 years of child abuse wherein the judiciary allegedly frustrated police investigations and the Pope threatened President Bertie (Parish of Boston-not-Berlin, says hello).

Guess why Ireland is ranked worse than China and Ghana for legal corruption by the World Bank. Is Poolbeg a good location to research legal corruption?

The Poolbeg Incinerator Hearings at Board Pleanala and at EPA-Ireland were apparently decided by unseen politicians above the heads of the professionals in those organisations. The boards appear to be loaded with either incinerator-industry-insiders or political-crony appointees. A fewyears ago John Gormley condemned EPA's director but now he's in charge he has done nothing about her.

Good science and the public good appear to have been ignored by the bosses of the regulators. Political cronyism at the banks, the alleged financial regulators and the building-industry have near-bankrupted the economy. Political cronyism operating on or in the other alleged regulators, EPA and Bord Pleanala, combined with an offshore-based waste-to-toxins incineration industry may shorten lives by up to two years across Dublin.

In the following diplomatic language the EU Commission seems to say the Poolbeg Incinerator Hearings were a sham:

‘Because of weaknesses in Irish legislation
splitting decision-making between planning authorities
and the
Environmental Protection Agency,
there are risks that outcomes required by the
EU directive will not always be achieved.’


With elections coming up Green-FF is spinning that the offshore operators have no money. Covanta-Poolbeg is based in Luxembourg. There are lots of offshored-banks in Luxembourg, almost nothing else. And Covanta has lots of money.

The proposed waste incinerator at Poolbeg is the subject of fresh controversy this week after it emerged that the EU has lodged legal proceedings against the Irish government over its handling of incinerator projects. EU Environment Commissioner Stavros Dimas has confirmed that Ireland was referred to the European Court of Justice in the last few weeks after it failed to respond to a final warning over alleged breaches of EU law. A statement issued by the Commission highlights concerns that all the environmental implications of the Poolbeg plant may not have been considered before it was approved in 2007. It reads, ‘Because of weaknesses in Irish legislation splitting decision-making between planning authorities and the Environmental Protection Agency, there are risks that outcomes required by the EU directive will not always be achieved.’

It’s the latest in a saga of legal controversy dogging the planned €266 thermal treatment facility, which has nonetheless managed to secure a licence to burn 600,000 tonnes of household waste a year. But this international case could be particularly embarrassing for Environment Minister John Gormley, who has previously been vocal in his opposition to Poolbeg. The Minister has come under fire from Dublin MEP Proinsias De Rossa for failing to respond to the EU’s written warning earlier. ‘This is yet another unnecessary, costly legal battle; it’s a sad state of affairs that Europe should have to take legal action against a Green Party Minister to ensure that all the implications of incineration are considered,’ he said.

Europe to prosecute Britain for breaking air pollution laws

Environment commissioner begins proceedings for failure to reduce particulate pollution from traffic and industry

Europe is prosecuting Britain for consistently breaking air pollution laws and endangering people's health in urban areas.

Legal proceedings against the government were started today by the EU environment commissioner, Stavros Dimas, and could result in unlimited daily fines.

Britain had been given nearly 10 years by Europe to reduce its levels of the minute, sooty "particulate matter" known as PM10s, which are mainly emitted by industry and traffic.

But EU documents seen by the Guardian earlier this month showed that Britain had been breaking the regulations, now part of UK law, for three years. More than 20 cities and conurbations were found to have dangerous levels of particulate matter between 2005-7.

In a statement, the commission said we have "started infringement proceedings against the United Kingdom for failing to comply with the EU's air quality standard for dangerous airborne particles known as PM10. These particles can cause asthma, cardiovascular problems, lung cancer and premature death."

The decision to take Britain to the court of justice will embarrass the government because it has had since 1999 to come up with a plan to reduce PM10 levels, but has failed to do so. All other major EU countries have submitted plans and successfully negotiated a time extension.

This week the government launched a consultation on the issue, but this was widely seen in Europe as a delaying tactic. The UK has two months to respond to the EU's letter before further action may be taken.

Dimas showed his exasperation with Britain. "Air pollution has serious impacts on health and compliance with the standards must be our utmost priority. It is essential that where time extensions are not applicable the standards are fully respected."

Air pollution near many roads in British cities averages well over twice the UN's World Health Organisation maximum recommended level. If Britain is to reduce PM10 levels it will have to substantially reduce traffic congestion, which could mean unpopular congestion charging and low emission zones.

A spokesman at the Department for Environment, Food and Rural Affairs said: "The UK, along with other member states, intends to apply for a time extension to meet PM10 air quality limits. Twenty-four out of 27 member states also reported breaches of the limits in 2007. We expect to apply for this extension following a public consultation that began on Tuesday 27 January."

But Caroline Lucas, leader of the Green party and MEP for the South East, said the move by the commission was a "damning indictment of Labour's aspirations to position itself as having any credibility on the environment at all". And she said it sent a clear signal to ministers who were going ahead with plans to expand Heathrow airport despite concerns that more planes will push pollution levels up even further.

"Legal action is long overdue," added Simon Birkett, director of Clean Air for London. "This should be a real wake up call to Britain to take air pollution seriously."

In a coincidence, the government also released data on air quality for 2008, showing that particulate pollution varied from year to year, and while there was a long-term decline, the fall was not fast enough to meet the new limits.

A Defra report said that "in urban areas, air pollution in 2008 was recorded as moderate or higher on 27 days on average per site, compared with 24 days in 2007, and 59 days in 1993".

Poolbeg Incinerator Promoters Credibility is in Question

It is difficult to establish how credible the incinerator’s promoters are. Are the promoters of the Poolbeg Incinerator any more credible than the directors of Anglo Irish Bank? Some of the information the promoters have provided to the public, or possibly withheld from the public for whatever reason, combined with other possible elements of The Big Lie Technique do not tend to inspire confidence in the promoter’s credibility.


Why Credibility Matters

Anglo Irish has grievously damaged Ireland’s Global Trust Rating. The peers of the incinerator promoters include Anglo Irish Bank, FAS, The EPA, An Board Pleanala, The HSE, The DDDA developer’s autocracy, the NRA, Dublin Port Company and so forth.

At director level, this group appears to be strongly linked with Fianna Fail. Along with many others this insular group seems to be loosely referred to as the The Galway Tent. The Galway Tent culture associated with some of this group has apparently misdirected national resources for the past eight years, totally wrecking the potential of the economy for perhaps a further ten years.

Only one view on the Poolbeg Incinerator has been presented to the public at a cost to taxpayers of €19,000,000. The promoter’s reports and claims have not apparently been subjected to any due diligence or peer review by a credible independent authority. The EPA, the HSE and An Bord Pleanala appear to be driven at director level by political appointees of Fianna Fail, so it’s naïve to suggest they are independent enough to robustly protect the public interest. Entities within the incineration industry provide further employment to these director-level public officials, a brass-necked conflict of interest denied by the promoters. The industry has also placed its employees into director level positions at some of these bodies – the poacher becomes policeman. The expensive experts used by the promoters were paid by the promoters, so it’s also naïve to suggest they are independent.

A monstrous white elephant implemented in the form of an ugly waste-to-toxins factory sitting in Dublin Bay is a fitting monument to the possibly self-serving members of the Galway Tent.

Trusting the promoters is too big a risk - the Poolbeg incinerator directly threatens people’s health. BSEM and WHO data suggests this is perhaps 100,000 man-years of reduced life expectancy between 2012 to 2027.

America’s EPA prices a human life at about eight million dollars. Technology is rapidly developing – within 10 year it’s likely that health damage will be traceable directly to the specific signatures of the pollution pumped out by the Poolbeg waste-to-toxins incinerator.

The financial risk from incineration health claims(a) could exceed the billions in bad-debt write-offs currently hidden from public view at Anglo-Irish Bank.
